Patrick Breaux sues Alliance Liftboats for unpaid overtime wages and other damages

In the United States District Court for the Eastern District of Louisiana, plaintiff Patrick Breaux and others similarly situated have filed a lawsuit against Alliance Liftboats, LLC and the L/B Miami. The case ID is 2:24-cv-01000-SM-KWR and it was filed on April 19, 2024. The lawsuit seeks to recover unpaid overtime wages and other damages under the Fair Labor Standards Act (FLSA) and Supplemental Rule C.

Patrick Breaux has been a crane operator and cook on vessels and liftboats for thirteen years, mainly serving as a cook aboard the L/B Miami for the past three years. He claims that he was paid a day rate, regardless of how many hours he worked, often exceeding 40 hours per week. Alliance classified Mr. Breaux as exempt from state and federal overtime laws, thereby denying him overtime pay.

The complaint alleges that Alliance misclassified Mr. Breaux and others in similar positions as exempt from state and federal overtime laws. Despite a ruling in Adams v. All Coast, LLC in February 2021 which should have clarified their obligation to pay overtime, Alliance continued to pay Mr. Breaux a day rate.

The plaintiff is seeking judgment for unpaid overtime wages along with other damages from Alliance Liftboats, LLC and against the L/B Miami under FLSA and Supplemental Rule C.
