Shaun Moyers sues Lieutenant W. Stowe for deprivation of rights under the Constitution and laws

In the United States District Court for the Eastern District of Louisiana, Shaun Moyers has filed a civil action against Lieutenant W. Stowe, Deputy John Wigstrom, and Sheriff Gerald A. Turlich Jr., under case number 2:24-cv-00974-DJP-DPC on April 18, 2024. The lawsuit is based on allegations of battery, intentional infliction of emotional distress, and deprivation of rights under the Constitution and laws of the United States and the State of Louisiana.

The plaintiff, Shaun Moyers, an Alabama resident, alleges that on July 14, 2023, several members of the Plaquemines Parish Sheriff's Office were dispatched to his temporary residence in Belle Chase, Louisiana for a welfare check. He claims that despite his assurance to deputies that he had no intention of harming himself after consuming a large quantity of alcohol that day, they decided to transport him to the hospital.

Moyers alleges that during this process he was tased multiple times by Lt. Stowe and Deputy Wigstrom which resulted in him falling and fracturing his left arm requiring surgery. The plaintiff asserts that at all material times he was unarmed and did not attempt to strike any deputies.

Moyers seeks judgment against the defendants for their actions which he believes were committed under color of state law and within their office or employment scope. He also accuses them of battery and intentional infliction of emotional distress as understood by Louisiana law.
