Worker files personal injury lawsuit against company for not making deck skid proof

After slipping and falling on a slippery deck, a Louisiana worker has filed a personal injury lawsuit that claims he would not have fallen if the deck was skid-proof.

David Mount filed suit against Apache Corp. on Dec. 6 in federal court in New Orleans.

Mount states he suffered a serious injury to his shoulder on Jan. 26, when he fell due to the slippery condition of the deck.

The defendant is accused of negligence for failing to properly maintain the area of the deck which caused Mount to fall, failing to properly design and outfit the deck, including to, lack of non-skid and other slip prevention measurements, failing to properly warn Mount regarding the dangerous condition on the deck and violation of maritime law.

The plaintiff is seeking damages for physical, mental and emotional pain and suffering, loss of wages, fringe benefits and wage earning capacity, physical disability, medical expenses, interest and court costs.

Mount is represented by Timothy J. Young, Jason C. Macfetters and Rebecca A. Coman of The Young Firm in New Orleans. A jury trial is requested.

U.S. District Judge Martin L. C. Feldman is assigned to the case.
