Scott A. Niemeyer and Freebooter Productions, LLC sue The Board of Directors of The Paragon Lofts Condominium Association, Inc. for a review of trial court's judgment

In the Fourth Circuit Court of Appeal in Louisiana, Scott A. Niemeyer and Freebooter Productions, LLC have filed a case against The Board of Directors of The Paragon Lofts Condominium Association, Inc., et al. The court case ID is 2024-C-0134 and the judgment was made on April 2, 2024.

The plaintiffs are represented by Richard G. Duplantier, Jr. and James A. Morock, Jr. from Galloway Johnson Tompkins Burr & Smith while the defendants are represented by Anne Derbes Wittmann and William E. Wildman, II from Baker, Donelson, Bearman, Caldwell & Berkowitz, PC. The lawsuit involves two separate suits; one referred to as the "Breach Suit" allotted to Division "F" and the other referred to as the "Collection Suit" allotted to Division "L".

The Collection Suit was filed by the Association against Scott Niemeyer, Freebooter Productions LLC ("Freebooter"), and Michael McKenzie (collectively known as "Paragon Lofts Defendants"). It alleged that the defendants owed delinquent condominium assessments related to roof repairs on the Paragon Lofts building.

The plaintiffs are seeking for a review of the trial court's February 7, 2024 judgment which denied their motion to reallot the matter to Division 'L'. They want this case transferred to Division 'L' for further proceedings.
