Grease on sidewalk outside of Emeril's restaurant leads to lawsuit

NEW ORLEANS-Two New Orleans residents have filed a lawsuit against Emeril's Restaurant after allegedly slipping in grease that had built up on the sidewalk.

Julie D. Hunt-Juneau and Paul C. Juneau filed suit against Emerils Homebase, Emerils, E.J.L Corp., L.J.E Partnership and The Travelers Indemnity Co. on July 9 in Orleans Parish District Court.

The defendants are accused of negligence for creating a hazardous and defective condition by allowing the surface of the sidewalk to become slippery by covering it with a substance believed to be a mixture of grease, food substances and other undissolved waste material.

The Juneaus argue that the restaurant swept, hosed or otherwise disbursed the waste from the kitchen of the restaurant onto the adjacent sidewalk towards the street but it left a slippery residue on the surface of the sidewalk.

The defendants are also accused of failing to properly train their employees as to the cleaning and maintenance of the sidewalk adjacent to the kitchen doors and failing to warn pedestrians about the slippery substances on the sidewalk.

The plaintiffs are seeking damages for pain and suffering, mental anguish, embarrassment, humiliation, medical expenses, lost wages, lost benefits, loss of opportunity, loss of earning capacity, property damage to Paul Juneau's clothing, loss of consortium, mental anguish, and emotional distress, plus interest and court costs.

The Juneaus are represented by Anthony J. Livaccari Jr. of Livaccari, Villarrubia, and Lemmon in New Orleans.

Judge Michael G. Bagneris is assigned to the case.
